Terms and conditions

1. Who we are

This shop is operated by SB Digital, the business behind Sidney van den Boogaard’s photographs, Gripvelden 14, 4707 ZD Roosendaal, Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 90232119, VAT identification number NL004335975B77. Email: info@sidneyvandenboogaard.com. In these terms, “we” means SB Digital and “you” means the customer.

2. When these terms apply

These terms apply to every offer on sidneyvandenboogaard.com and to every order placed there. You can read, save and print them before you order; they are linked from the bag. Where these terms conflict with mandatory consumer law, the law applies.

3. Prints and prices

• We sell fine art prints of Sidney van den Boogaard’s photographs in standard sizes. Each print is made to order on the paper stated on the product page, with a white border. Each photograph has an edition of 25 prints in total across all sizes.
• Prices are in euros and are final prices. We use the Dutch small business scheme (KOR, article 25 of the Dutch VAT Act), so no VAT is charged. Tracked delivery within the EU is included.
• Colours on a screen can differ slightly from the colours of a print on paper. Obvious mistakes in the offer, such as a wrong price, do not bind us.

4. Your order

The contract is made when you have completed payment at checkout. We confirm your order by email, with a personal link to follow it. For two hours after the order you can change the delivery address or cancel through that link, at no cost. After that, your print goes into production.

5. Payment

You pay at checkout through our payment provider Stripe, for example with iDEAL, a credit card, Bancontact or Apple Pay. We never see your full card details.

6. Delivery

• We deliver to addresses in the European Union. Delivery normally takes 4–6 working days after your order.
• If we cannot deliver within 30 days, we tell you, and you may cancel the order and get your money back.
• The risk of loss or damage passes to you when the print is delivered at your address.

7. Right of withdrawal

You have the right to withdraw from the contract within 14 days after you (or someone you named) received the print, without giving a reason. Our prints are standard products and are not made to your personal specifications, so this right applies.

• To withdraw, tell us within the 14 days, by email to info@sidneyvandenboogaard.com or with the model withdrawal form.
• Return the print within 14 days after telling us, to Gripvelden 14, 4707 ZD Roosendaal, Netherlands. You pay the direct cost of returning it.
• We refund all payments received from you, including standard delivery costs, within 14 days after we receive your withdrawal, with the same payment method. We may wait until we have received the print, or until you show that you have sent it back.
• You are responsible for any loss in value caused by handling the print beyond what is needed to judge it.

8. Quality and complaints

Every print must be as described and fit for display. This is your statutory right (conformity), and these terms do not limit it. If something is wrong — damage in transit, a printing fault, the wrong print — please tell us as soon as possible, with photos, by email to info@sidneyvandenboogaard.com. A report within two months of discovering a defect is always on time. We reply within 14 days and, depending on the problem, send a new print or refund you.

9. Copyright

All photographs remain the copyright of Sidney van den Boogaard. Buying a print gives you the print itself: you may hang it, sell it or give it away, but not copy, scan or publish the photograph.

10. Privacy

We use your personal data only as described in our privacy policy.

11. Applicable law and disputes

Dutch law applies to these terms and to every order. If you live in another EU country, you keep the protection of the mandatory consumer law of that country. Please contact us first if you have a complaint; we will do our best to solve it together. If that does not work, the dispute can be brought before the competent court.

12. Changes

We may change these terms. The version that was on this page when you placed your order applies to that order.
